TYPOGRAPHICAL ERRORS
In the event a product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information received from our suppliers, Tamlyn.com shall have the right to refuse or cancel any orders placed for product listed at the incorrect price. R.H. Tamlyn & Sons, LP. shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, R.H. Tamlyn & Sons, LP. shall immediately issue a credit to your credit card account in the amount of the charge.
SALES TAX
R.H. Tamlyn & Sons, LP. shall automatically charge and withhold the applicable sales tax for orders to be delivered to addresses within Texas unless a valid Texas sales tax number is provided. Each customer shall be solely responsible for all sales taxes, or other taxes, on orders shipped to any other state.
IDEA SUBMISSION POLICY
Thank you for your interest in submitting an idea or item to R.H. Tamlyn & Sons, LP. We are fortunate to receive many submissions from our Community. However, as you may be able to appreciate, many of these submissions contain both old and new ideas, and others contain ideas or elements of ideas that are already in development at R.H. Tamlyn & Sons, LP. Accordingly, R.H. Tamlyn & Sons, LP. cannot receive such ideas or items in confidence. Submission of your idea or item will constitute acceptance by you of the following idea submission policy.
You represent that you are the sole and exclusive owner (or the authorized agent of the entity which is the owner) of said item or idea and are of legal age. You submit your idea or item voluntarily and you understand that this submission by you and its acceptance by R.H. Tamlyn & Sons, LP. does not, in whole or in part, establish or create by implication or otherwise any relationship between R.H. Tamlyn & Sons, LP. and you not expressed here. No confidential relationship is to be established by such submission or implied from consideration of the submitted material, and the material is not considered to be "submitted in confidence."
R.H. Tamlyn & Sons, Inc., in its own judgment, may accept or reject the idea or item submitted and shall not be obligated to you in any way with respect to your idea or item. R.H. ACCEPTANCE OF ORDERS
Receiving an order acknowledgement via e-mail does not guarantee the acceptance of an order. R.H. Tamlyn & Sons, LP. reserves the right to limit the quantity of items ordered and/or refuse to sell to any customer.
WARRANTY
TAMLYN warrants defective-free products for a period of 10 years for the original purchaser. TAMLYN products are further warranted as to adequacy of design, provided products are properly specified and installed. This warranty does not apply in the event products are altered in any way or are improperly installed. Liability is limited to replacement of products proven to be defective. TAMLYN has made no other warranty, express or implied, regarding its products, including but not limited to, any warranty regarding merchantability or fitness for a specific purpose. Any claim that a product is defective must be brought within 1 month of the date of installation of such products to the original purchaser. Customer hereby agrees that no other incidental or consequential damages are the responsibility of TAMLYN
The PVC TAMLYN buys is an industry-standard, rigid, durable, chemically resistant product designed for outdoor weatherability. While the PVC is paintable, we cannot know what may be added to paints, primers etc. that could affect the PVC. Installers must consult with the paint manufacturer's technical department for their specific recommendations on priming and painting PVC. Where parts are designed to work together, TAMLYN vinyl products are not warranted if installed in conjunction with other non-Tamlyn vinyl products. Use light or pastel latex paint colors only on TAMLYN trim. Use of dark color paint will void warranty. Tamlyn vinyl products are not warranted if nailed through the product. Allow 1/16" gap on nail for expansion and contraction
HOW TO RETURN ITEMS
To return items simply call us at 800.334.1676. A Tamlyn customer service representative will issue a return approval and assist you with return shipping. We accept returns only if the product has been mis-shipped or the item fails the warranty listed above. For any other reason like the wrong product was ordered or the customer no longer wants the product. The customer will be required to pay for the return shipping and will be penalized a 15% restocking fee. Your return must include the following: • Return product in its present condition. • All of the parts that the manufacturer included with the product if available. • Packing slip with reason for return. Make sure to wrap the item securely and keep the tracking number of the return package. We suggest that you purchase insurance for the item since we are not responsible for merchandise that is lost in return shipping. We recommend UPS or Insured Parcel Post.
SHIPPING OPTIONS AND RATES
R.H. Tamlyn & Sons, LP. ships all packages via United Parcel Service unless for large quantity orders were palletized trucking may be more economical, please call us to make arrangements. The majority of the items on our site are ready to ship on the same business day. Other delivery services are available upon request.
Note that shipping time is listed in business days and does not include weekends or holidays. At this time, only one shipping method may be chosen per order and orders can only be delivered to one address. If multiple shipping destinations are needed, separate orders must be placed.
R.H. Tamlyn & Sons, LP. charges for shipping based on regular UPS charges, which are based on weight and destination, plus a $5.00 shipping and handling charge. UPS Ground shipping is not an option for deliveries to Alaska or Hawaii. UPS Next Day Air Saver, 2nd day air, or 3 day select offers an affordable delivery option for those important shipments that require timely delivery, but don't have to be there in the next morning.
R.H. Tamlyn & Sons, LP. does not guarantee delivery time based on promises made by a third party (UPS, Fed-Ex, ect.). R.H. Tamlyn & Sons, LP. guarantees that any order received before 5:00pm will be shipped that day via the requested shipping method. R.H. Tamlyn & Sons, LP. does not cover any guarantees made by any shipping carrier pertaining to transit and delivery time.
INTERNATIONAL ORDERS
R.H. Tamlyn & Sons, LP. can not accommodate international orders. We define an international order as an order that has a shipping or billing address outside the fifty United States.
PAYMENT ACCEPTED
R. H. Tamlyn & Sons, Inc accepts most credit cards. Corporate accounts are available and can be billed by mail or via email. Corporate accounts can be paid via credit card, check, money order, wire transfer or bank transfer. Please call or fax to request credit application. Credit application may be available for online download or via email.
JURISDICATION AND VENUE
You agree that any legal action brought against R.H. Tamlyn & Sons, LP. shall be governed by the laws of the State of Texas without regard to its conflict of law principles. You agree that the sole jurisdiction and venue for any litigation arising from your use of or orders made on the Tamlyn.com web sites shall be an appropriate federal or state court located in Fort Bend County, Texas.
